Air Display Terms and Conditions

General

Air Display is the Air Display Hot Air Balloon Team.  Air Display is owned and managed by Rolland Enterprises Inc.

Hot Air Balloon Ride Services

  • Scheduled passenger rides from one to five persons.  Rides may be reserved as shared or as a private charter.  Singles must be scheduled with another party or as a private charter.

  • Scheduled hot air balloon passenger rides for reseller vendors including other balloon ride companies.

  • Presentable Balloon Ride Certificates for future balloon rides purchased by a third party not participating in the ride.  Certificates are paid in full and not refundable. Certificates have no cash value.

  • Presentable Balloon Ride Vouchers for future balloon rides in $100 (+HST) increments by a third party not participating in the ride.  Vouchers are a partial payment towards a future balloon ride.  Vouchers have no cash value.

What Is Included With The Hot Air Balloon Ride

  • Maximum of five passengers (typically for adults) on each flight ensures you receive the attention you deserve.

  • The services of an experienced, Transport Canada licensed hot air balloon pilot.

  • Detailed flight confirmation email containing all instructions.

  • Personalized flight notification call providing an advance weather forecast and answers to last minute questions.

  • Passengers and crew meet only if the weather forecast for the flight is promising to minimize balloon ride cancellations on the field.

  • The services of two to three experienced ground support crew team members who assist with the inflation, tracking and recovery of the balloon and riders.

  • Journey to the launch site from the designated meeting location in a comfortable,
    full-sized commercially insured vehicle.

  • Pre-flight passenger safety briefing.

  • Hot air balloon inflation and deployment.

  • About a one hour balloon flight to a destination where the wind takes us.  Flight at altitudes of up to 5,000 feet above ground level and contour flying that skims the tops of trees as atmospheric conditions permit.

  • Traditional balloonist champagne toast and story telling. Non-alcoholic bubbly and other beverages also served.

  • Return journey after the balloon ride to the designated meeting location.

  • 300,000$ per passenger liability aviation insurance as required by the Canadian Aviation Regulations.

  • Opportunity to receive an inflight photo at no charge

  • An invitation to publicly comment on your balloon ride experience with Air Display. 

Passenger Suitability

Please review the following to determine your party's suitability to flying in a hot air balloon:

  • Ballooning is an outdoor rural activity.  If you have serious, life threatening allergies be prepared (e.g. EpiPen) and ensure the pilot is aware.

  • If you are pregnant you should not fly in a hot air balloon.

  • For passenger safety, individual passenger weight not to exceed 250 lbs (113.4 kg). Passengers weighting greater than 250 lbs may sometimes be accommodated by reserving a private charter flight (assuming the other physical requirements are met).  Please contact Air Display by email or telephone to discuss.

  • Total passenger group weight not to exceed 875 lbs (397 kgs).

  • Passengers must be physically fit for easy to modest exertion.  A jump from the seat of a standard kitchen chair would be equivalent to the typical landing impact of a hot air balloon.

  • Passengers must be able to see over the edge of the  basket.  Basket height is 42 inches (107 cm).

  • Passengers must be able to hoist themselves into and out of the basket using a foot hold located mid height of the basket wall with minimum assistance.

  • The passenger must be able hang on to the conveniently located, leather grips, to restrain themselves.  Passengers must be able to hang on unassisted and with both hands.  They will not be able to restrain or hold onto another person.

  • There is no seating in a hot air balloon basket and the flight may last up to 1.5 hours. Passengers may lean on the basket side rails for support or sit on the basket floor if necessary.

  • Passengers may be required to hike from the balloon landing location to the recovery vehicle.  These hikes may be across uneven terrain.

  • If you have conditions which may require another persons's assistance, that person must fly with you.

  • Children must be at least seven years old and able to hang on and restrain themselves using the leather handle grips meaning, not hanging on to Mom or Dad.

  • Air Display has no upper age limit however, the frail and weak are not recommended. Standing duration, landing impact and holding strength must all be considered.

  • Previous injuries could be aggravated particularily recent surgeries neck, back, knee and dislocated shoulders.

  • Medical auxilliaries such as canes, walkers or oxygen bottles are not permitted in the balloon basket.

  • If you have a medical condition or questions regarding your capabilities to fly in a hot air balloon, please ask your Medical Practitioner for advice and notify Air Display.

No Air Display balloon crew member including the pilot is a medical practitioner.  The above information is given to help perspective passengers make an informative decision.

Balloon Adventure Duration

Ballooning is inexact in that balloons fly in the direction and speed of the wind and do not have direct steering abilities.

 

Air Display strives for a balloon ride of one hour.  However the actual flight may be from 45-90 minutes.  There are a number of variables (e.g. direction of flight, changing weather and the availability of suitable landing sites) that can influence the duration of a balloon ride.  These variables are outside the control of Air Display and if not acted upon may affect the safety of passengers, crew and equipment.  For this reason, Air Display can not guarantee a balloon flight duration of one hour.

 

Expect about four hours total time from when we meet until the time your party is returned to the designated meeting location.

Balloon Ride Payment

The Air Display Balloon Ride Certificate is purchased in advance by a third party who not participating in the balloon ride.  There is no outstanding fare balance.

 

The Air Display Balloon Ride Voucher is a partial payment for a balloon ride.  These are purchased in advance by a third party not participating in the balloon ride.  When using a Balloon Ride Voucher towards the purchase of a balloon ride, there is an outstanding fare balance.  This fare balance is collected after the balloon ride.  When reserving your flight a valid credit card will be required.  For security reasons DO NOT send credit card details by email or when using the Air Display CONTACT form.

 

For all other scheduled balloon rides, the fare is collected after the balloon ride.  When reserving your flight a valid credit card will be required.  For security reasons DO NOT send credit card details by email or when using the Air Display CONTACT form.

 

Payment may be by cash, personal cheque (written against an Ontario, Canada bank account and with identification), VISA, MasterCard or AMEX.

Balloon Ride Certificates and Vouchers

Air Display provides balloon rides for a number of ticket resellers referred to as third party vendors.  Clients (passengers) who have a third party ride certificate or vouchers must abide by the rules of their respective vendor.  Third party vendor ride certificate or voucher rules may be different from those of Air Display.

 

The following balloon ride certificate and voucher details are for Air Display Balloon Ride Certificate and Voucher holders.

  • The Air Display Balloon Ride Certificate and Voucher are not refundable and have no cash value.  This was a condition of sale.

  • Validated Balloon Ride Certificates and Vouchers do not expire.

  • The Air Display Balloon Ride Ride Certificate and Voucher are validated by scheduling a hot air balloon ride each flying season (May through October) and having no outstanding "short notice" cancellation penalties (see "Balloon Ride Canacellation Fees" for more details).

If the recipient fails to keep their Ride Certificate or Voucher validated, it will be considered redeemed.

If the scheduled hot air balloon ride is cancelled by Air Display (e.g. due to weather), Balloon Ride Certificate and Voucher holders must reschedule.

Balloon Boarding Rules

The pilot will identify themselves to each passenger.

The pilot is the sole charge aboard the balloon and has authority over all passengers.

The pilot may remove any passenger or object deemed a threat to passenger safety or to the safety of those on the ground.  Air Display will consider a removed passenger has cancelled "last minute".  See "Balloon Ride Cancellation".

If at the time of boarding, a passenger is not deemed fit by the pilot (e.g. they appear to be under the influence of drugs or alcohol or in some physical distress or otherwise too fragile to fly in a hot air balloon), Air Display will consider the passenger has cancelled "last minute".  See "Balloon Ride Cancellation".

Balloon Ride Cancellation

Air Display reserves the right to cancel a scheduled hot air balloon ride (e.g. due to weather, security or other safety reasons) without penalty.  To minimize the unnecessary assembly of passenegers (clients) and crew, Air Display provides an advance flight notification call.  Air Display does not meet  passengers and crew unless the weather forecast is promising.   Although every effort is made to accurately predict the weather for a particular flying period, flight cancellation on the field is always possible.

If the balloon ride is cancelled by Air Display (e.g. weather cancellation) and the client chooses not to reschedule their balloon ride:

  • For clients who do not have a ride certificate or voucher, there is no charge.  Credit card data destroyed at the client's request.

  • Balloon Ride Certificate holders must reschedule their balloon ride.  Ride Certificates have no cash value and are not refundable.

  • Balloon Ride Voucher holders must reschedule their balloon ride.  Vouchers have no cash value and are not refundable.

If the client requests their scheduled balloon ride be rescheduled and at least seven days notice is given to Air Display, there is no penalty. 

If the client requests their scheduled balloon ride be cancelled and at least seven days notice is given to Air Display:

  • For clients who do not have a ride certificate or voucher, there is no charge.  Credit card data destroyed at the client's request.

  • Balloon Ride Certificate holders must reschedule their balloon ride.  Ride Certificates have no cash value and are not refundable.

  • Balloon Ride Voucher holders must reschedule their balloon ride.  Vouchers have no cash value and are not refundable.

If the client cancels a reserved flight with less than seven days but more than 48 hours notice is given to Air Display, a cancellation penalty will be applied to their credit card.  See "Balloon Ride Cancellation Fees".

If the client cancels a reserved flight with less than 48 hours notice given to Air Display or is late for their scheduled rendezvous, Air Display will consider these clients to have cancelled their flight "last minute".  See "Balloon Ride Cancelation Fees" for details.

If at the time of boarding, the client or a member of the client's party refuses to fly (i.e. the balloon ride was a surprise) and an acceptable (to Air Display) replacement passenger is not provided by the client, then Air Display will consider the reservation cancelled "last minute".   See "Balloon Ride Cancellation Fees".

Balloon Ride Cancellation Fees

If the client (passenger) cancels a reserved flight with seven or more days notice given to Air Display and the client chooses to not reschedule their balloon ride:

  • For clients who do not have a ride certificate or voucher, there is no charge.  Credit card data destroyed at the client's request.

  • For clients with a valid Balloon Ride Certificate, the certificate may be transferred by the client.  There is no refund or cash value for Ride Certificates.

  • For clients with a valid Balloon Ride Voucher, the voucher may be transferred by the client.  There is no refund or cash value for balloon ride vouchers.

If the client cancels a reserved flight with less than seven days but more than 48 hours notice given to Air Display, the "short notice" cancellation penalty is 15% of the total fare.

  • For clients who do not have a Balloon Ride Certificate or Voucher, the penalty will be charged to the reserving credit card.

  • For clients with a Balloon Ride Certificate, the penalty must be paid to Air Display within 5 business days or the certificate will be considered redeemed.

  • For clients with a Balloon Ride Voucher, the penalty must be paid to Air Display within 5 business days or the voucher will be considered redeemed.

If the client cancels a reserved flight with less than 48 hours notice given to Air Display or is late for their scheduled rendezvous or fails to show, the "last minute" cancellation penalty is 100%.

  • For clients who do not have a Balloon Ride Certificate or Voucher, the penalty will be charged to the reserving credit card.

  • For clients with a Balloon Ride Certificate, the certificate will be considered redeemed.

  • For clients with a Balloon Ride Voucher, the voucher will be considered redeemed and the outstanding fare difference will be charged to the reserving credit card.

Hot Air Balloon Flight Regime

Rolland Enterprises Inc. conducts fare-paying passenger rides under a Special Flight Operations Certificate (SFOC) issued by Transport Canada.

 

Hot air balloon pilots are Transport Canada licensed.  Pilots must remain current as per the Canadian Aviation Regulations (CARs).  Pilots must be medically fit as certified by Transport Canada aviation medical experts. 

 

The hot air balloons owned by Rolland Enterprises Inc. are Transport Canada, certified aircraft.  Certified aircraft must abide by the inspection and maintenance rules defined by the CARs.

 

Hot air balloon flights are conducted under Visual Flight Rules (VFR) as defined by the CARs.

Balloon Ride Limits of Liability

Balloon flights are subject to the CARs Part IV, "General Operating Flight Rules", Section 606.02: Liability Insurance, Subsection (1), (2), (3) and (5).  This section applies to every owner of an aircraft registered in Canada.

 

Subject to Subsection (3), no operator of a balloon in which fare-paying passengers are carried on board, shall operate an aircraft unless, in respect of every incident related to the operation of the aircraft, the operator has subscribed for liability insurance covering risks of injury or death of a passenger in an amount that is determined by multiplying $300,000 by the number of passengers on board the aircraft.  The insurance coverage referred to in Subsection (3) need not extend to any passenger who is carried on board for the puropose of conducting a parachute decent.

 

No balloon owner shall operate an aircraft unless, in respect of every incident related to the operation of the aircraft, the owner has subscribed for liability insurance covering risks of public liability in an amount not less than $1,000,000 where the maximum permissible take-off weight of the aircraft is not greater than 7,500 lbs.

 

Rolland Enterprises Inc. assumes no liability for lost or damaged bagggage, personal effects (including clothing) or inconvenience of the passenger or any member of the passenger's party.

 

Rolland Enterporises Inc. is not responsible for parking, admission, accommodation or travel costs incurred by the passenger or any member of the passenger's party.

 

By scheduling a balloon ride with Rolland Enterprises Inc. the passenger agrees to the terms of the Rolland Enterprises Inc. "WAIVER".
