Air Display Terms and Conditions

General

Rolland Enterprises Inc. owns and manages Air Display.  Air Display may also be referred to as the Air Display Hot Air Balloon Team.

 

Hot air balloons that carry passengers for hire are Transport Canada certified aircraft.

 

All pilots must abide by the Canadian Aviation Regulations (CARs).

 

Hot air balloon rides may be refered to as the ride or flight.  Rides may be shared meaning, other passengers will be on board with you or private charter meaning, only your party and the pilot will be on board.

 

The Air Display Hot Air Balloon Team consists of a licensed Pilot and at least two but usually three, person ground crew.  The ground crew are also be referred to as the chase crew and/or retrieve crew.

 

Ride clients may be referred to clients or passengers.

 

Air Display schedules hot air balloon rides from one to five passengers.  Air Display will accept a reservation for two or more passengers.  Singles may reserve a particular date and time however the flight may be cancelled due to lack of participation should no other passengers reserve a balloon ride for the same period.

 

All balloon rides are weather dependent.  Air Display does not control the weather and therefore cannot guarantee a scheduled balloon ride will take place.  Ride cancellation  due to weather, is common with balloons.  Coincident rain dates are not scheduled.

 

Hot air balloons fly in the direction and speed of the wind.  Balloons do not steer and do not return to their launch point.  The  chase crew follows the balloon and retrieves the aircraft and its occupants after the flight.

 

Air Display uses experienced, volunteer ground crew.  Although ride cancellation due to crew unavailablility is rare, it is possible.

 

Air Display's balloon rides are about one hour in duration.  For technical  reasons, flight duration may be shorter or longer.  Air Display does not guarantee your balloon ride will be one hour in duration.

 

Air Display schedules hot air balloon rides at sunrise or early evening, a couple of hours before sunset   There is no daytime flying of hot air balloons.

 

Passenger greeting locations are chosen for their conveniences.  Parking, beverages, snacks and facilities are available at Air Display's greeting locations.  Any fees associated with these amendities are the responsibility of the passenger.  Air Display does not launch hot air balloons from its passenger greeting locations.

 

Hot air balloons land on unconditioned surfaces (e.g. fallow fields, dirt roads, unattended parks etc.) and surfaces may be uneven.  Access by the retrieval crew is required.  Because landings are not on hard surfaces, wet ground conditions such as after a rain or  a late Spring thaw, may require the balloon ride to be cancelled.

Hot Air Balloon Ride Sales

Air Display does not charge in advance for its balloon rides unless the ride is purchased by a third party (i.e. a person or organization not participating in the balloon ride).

A valid credit card and a per person administration fee is required to hold a reservation.  The administration fee is not refundable however it is deducted from from the balloon ride fare after the flight concludes.  Credit cards are not required for balloon ride certificate holders.  Administration fees are not charged to balloon ride certificate or balloon ride voucher holders.

Air Display sells balloon ride certificates.  An Air Display Balloon Ride Certificate is a presentable ticket for a balloon ride purchased in advance by a third party.  Certificates can be issued for one up to five passengers (depending on passenger weight) and for either a shared or private charter balloon ride.  Certificates are not refundable.

Air Display sells balloon ride vouchers.  An Air Display Balloon Ride Voucher is a partial payment towards a balloon ride with Air Display.  Vouchers are purchased by a third party.  Vouchers may be used for a shared or private charter balloon ride.  Vouchers are sold in increments of $100.00 and are not refundable.  More than one voucher may be used at a time.

HST (tax) is in addition to all fares.  HST in Ontarion is 13%.

What Is Included With The Hot Air Balloon Ride

Maximum of five passengers on each flight to ensure your ride is personable.

 

The services of an experienced, Transport Canada licensed, hot air balloon pilot.

 

The volunteer services of an experienced ground crew team that assists with the balloon's inflation, tracking and recovery.

 

An opportunity to "live speak" and discuss ballooning with an experienced operator before reserving your balloon ride or purchasing a ride certificate or voucher.

 

Detailed flight confirmation email containing all the necessary instructions (e.g. meeting address, time, date, what to wear, how to pay etc.).

 

Personalized preflight telephone notification that provides the status of your balloon ride and an opportunity to ask last minute questions.

 

Minimized inconvenience of having your balloon ride cancelled on the field.  Air Display meets passengers only if the weather outlook for the flight is promising.  Unfortunately there always remains the possibility of a field cancellation should the weather forecasters be incorrect however, Air Display takes the time and effort to minimize your travel time.

 

Journey to the launch site from the designated greeting location in a comfortable,
full-sized commercially insured and annually inspected vehicle.

 

Pre-flight safety briefing.

 

Hot air balloon inflation and deployment.

 

About a one hour balloon flight to a destination where the wind takes us.

 

Hot air balloon packup and stowage.

 

Flight at altitudes of up to 5,000 feet above ground level (agl) and contour flying that skims the tops of trees as atmospheric conditions permit.

 

Traditional balloonist, champagne toast and story telling after every flight.  Non-alcoholic bubbly and other beverages also served.

 

Return journey after your balloon ride to the designated greeting location.

 

Passenger liability aviation insurance as required by the Canadian Aviation Regulations (CARs).

 

Opportunity to receive (by email) an inflight photo at no charge.  The pilot usually has an opportunity to take a memorable photo of yourselves during your ride.  Unfortunately we cannot guarantee a photo or its quality.

Passenger Suitability

All aircraft which includes hot air balloons, have a maximum allowable weight they can carry.  This is called gross lift.  Air Display's passenger capacity (numbers and weights) are based this value.  If either yourself or your party exceed Air Display's weight limits we will try to offer you options which may have a surcharge or require your reservation to be a private charter.  Please be aware, Air Display means no disrespect if your reservation request cannot be accommodated. 

NOTE

No Air Display balloon crew member (including the Pilot!), is a Medical Practitioner.  This  information is only given to help perspective ride clients make an informed decision.

The following is for safety.  Please read before you reserve a balloon ride with Air Display or purchase an Air Display Balloon Ride Certificate or Voucher:

 

  • If you have a medical condition or questions regarding your capabilities to fly in a hot air balloon, please ask your Medical Practitioner for advice and notify Air Display when you make your reservation.  Air Display means no disrespect if your reservation request cannot be accommodated.

  • All ride clients (passengers) must comply with the pre-flight and landing instructions provided by the Pilot.  Failure to do so may result in personal injury to yourself or others on board the balloon.

  • Hot air ballooning is an outdoor, rural activity.  If you have serious or life threatening allergies be prepared (e.g. EpiPen) and ensure the Pilot and Crew are aware.

  • If you are pregnant do not fly in a balloon.

  • Individual passenger weights not to exceed 240 lbs (109 kg).  Passengers weighing 240 lbs or greater, may sometimes be accommodated by reserving a private charter.  Contact Air Display by email or telephone to discuss.

  • Maximum passenger group weight not to exceed 825 lbs (374 kgs) for five persons.  Group of less than five passengers whose total weights approaches this limit may be  required to fly as a private charter.

  • Passenger weight limits apply to all balloon ride participants, including Air Display Balloon Ride Certificate and Voucher holders.
  • Passengers must be physically fit for modest exertion.

  • Passengers must be able to hoist themselves into and out of the gondola using a foot hold located at a height of 21" (53 cm) with minimum assistance.  Basket wall height is 42 inches (107 cm).

  • Passengers may be required to hike from the balloon landing location to the recovery vehicle.  These hikes may be across uneven terrain.

  • Passengers must be able hang on to conveniently located hand holds (leather grips) to restrain themselves.  You must be able to hang on unassisted and with both hands meaning, you will not be able to restrain or hold onto another person or equipment (e.g. camera).  Obviously, recent ailments such as sprains, broken limbs or dislocated shoulders will seriously hamper your ability to hang on tightly when requested.

  • Children must be at least seven years old, able to hang on and restrain themselves using the gondola's internal hand holds.

  • A jump from the seat of a standard kitchen chair would be equivalent to the landing impact of a hot air balloon.

  • Passengers must be able to see over the edge of the basket.  Basket height is 42 inches (107 cm).

  • There is no seating in the gondola and the flight may last up to 1.5 hours.  Passengers may lean on the basket rail for support or sit on the basket floor if necessary.  Support appliances (e.g. canes or walkers) are not allowed.

  • If the passenger has a condition that requires or may require, another persons's assistance, that person must fly with them.

  • Air Display has no upper age limit however, the frail and weak are not recommended. Standing duration, landing impact and hold on strength must all be considered.  When we meet for your scheduled balloon ride and If you or your guest is deemed too frail to fly by the Pilot, you may be subject to the fees associated with a "last minute" cancellation.  See "Balloon Ride Cancellation Fees" below.

  • Previous injuries could be aggravated particularily recent surgeries neck, back, knee and dislocated shoulders.

  • Medical appliances such as canes, walkers or oxygen bottles are not permitted in the balloon basket.

Balloon Ride Duration

Ballooning is inexact in that balloons fly in the direction and speed of the wind.  Balloons  do not have direct steering capabilities.

 

Air Display strives for a balloon ride of one hour.  However, the actual flight may be from 40-90 minutes.  There are a number of variables (e.g. direction of flight, changing weather and the availability of suitable landing sites) that can influence the duration of a balloon ride.  These variables are outside the control of Air Display and if not acted upon, may affect the safety of passengers, crew and aircraft.  For these reasons, Air Display cannot guarantee a balloon flight duration of one hour.

 

Expect up to four hours total time from when we meet until the time your party is returned to the greeting location.  Ballooning is an adventure!

Balloon Ride Payment

A valid credit card is required to make a balloon ride reservation.  There is a per person, non-refundable balloon ride booking fee.  This fee is deducted from the balloon ride fare.

 

Balloon ride fares are collected after the balloon ride is provided.  The fare does not have to be paid by credit card. 

 

Payment may be by cash, e-transfer, personal cheque (written against an Ontario, Canada bank account and with identification), VISA, MasterCard or AMEX.  If paying by credit card and the card you wish to use is what was given to make your balloon ride reservation, please have this card with you for verification.  If paying e-transfer, the appropriate email address will be provided at that time.  If paying by cheque, please make cheque payable to Rolland Enterprises Inc.

 

Air Display Balloon Ride Certificates are an Air Display balloon ride paid in full.  Ride Certificates are purchased in advance by a third party.  Third parties do not participate in the balloon ride.   There is no booking fee and no outstanding fare balance after the ride.  Certificate holders do not need to provide a credit card to make a reservation.  Muliple ride certificates may be used on the same flight.  A combination of ride certificates and Air Display Balloon Ride Vouchers may be used on the same flight.

 

Air Display Balloon Ride Vouchers are a partial payment for an Air Display balloon ride. Vouchers are purchased in advance by a third party.  Third parties do not participate in the balloon ride.  Balloon Ride Vouchers have an outstanding fare balance due after the balloon ride is provided.   A valid credit card is required to make a balloon ride reservation.  Multiple vouchers may be used on the same flight.  A combination of vouchers and Air Display Balloon Ride Certificates may be used on the same flight.

Balloon Ride Certificates and Vouchers

Air Display provides balloon rides for a number of ticket resellers referred to as third party vendors.  You must confirm Air Display will accept your third party ticket before reserving a balloon ride.  Clients (passengers) who have a third party ride certificate or vouchers must abide by the rules of the selling vendor.  Third party vendor ride certificate or voucher rules may be different than those of Air Display.

 

The following details are for Air Display Balloon Ride Certificate and Voucher holders:

The Air Display Balloon Ride Certificate and Voucher are not refundable and have no cash value.  This was a condition of sale.

 

The Air Display Balloon Ride Ride Certificate and Voucher are validated by scheduling a hot air balloon ride at least once each flying season (May through October) and having no outstanding "short notice" cancellation penalties (see "Balloon Ride Cancellation Fees" for more details).

 

Balloon Ride Certificates and Vouchers must be validated within one year of receipt.

 

To validate a Ride Certificate or Voucher, the holder must book a balloon ride with Air Display at least once per flying season or the Ride Certificate or Voucher will be deemed fulfilled.

 

If the recipient fails to keep their Ride Certificate or Voucher validated, it will be considered redeemed.

 

Validated Balloon Ride Certificates and Vouchers do not expire provided 

 

Validated Balloon Ride Certificates and Vouchers are transferrable.

 

If the scheduled hot air balloon ride is cancelled by Air Display (e.g. due to weather), Balloon Ride Certificate and Voucher holders must reschedule.

Balloon Boarding Rules

The Pilot will identify themselves to each passenger.

The Pilot is the sole charge aboard the balloon and has authority over passengers and crew.

The Pilot may remove any passenger or object deemed a threat to on board safety or to the safety of those on the ground.  Air Display will consider a removed passenger as having cancelled "last minute".  See "Balloon Ride Cancellation" below.

If at the time of boarding, a passenger is deemed "not fit" by the Pilot (e.g. they appear to be under the influence of drugs or alcohol or in some way distressed or too fragile or too heavy to fly in a hot air balloon), Air Display will consider the passenger has cancelled "last minute".  See "Balloon Ride Cancellation" below.

Balloon Ride Cancellation

Air Display reserves the right to cancel a scheduled hot air balloon ride (e.g. due to weather, security or other safety reason) without penalty.  To minimize the unnecessary assembly of passenegers (clients) and crew, Air Display provides an advance flight notification telephone call.  Air Display does not meet passengers unless the weather forecast is promising.   Although every effort is made to accurately forecast the weather for a flying period, weather cancellation on the field is always a possibility.

If the balloon ride is cancelled by Air Display (e.g. weather cancellation) and the client chooses not to reschedule their balloon ride:

For clients who do not have a ride certificate or voucher, there is no charge.  Credit card data will be destroyed at the client's request.

 

Balloon Ride Certificate holders must reschedule their balloon ride.

 

Balloon Ride Voucher holders must reschedule their balloon ride.

If the client requests their scheduled balloon ride be cancelled or rescheduled and at least seven days notice from the time of the reservation is given to Air Display, there is no penalty. 

For clients who do not have a ride certificate or voucher, there is no charge.  Credit card data will be destroyed at the client's request.

 

Balloon Ride Certificate holders must reschedule their balloon ride.

 

Balloon Ride Voucher holders must reschedule their balloon ride.

If the client cancels their reserved flight with less than seven days but more than 48 hours notice from the time of the reservation to Air Display, a cancellation penalty will be applied to their credit card.  See "Balloon Ride Cancellation Fees".

If the client cancels their reserved flight with less than 48 hours notice from the time of the reservation, given to Air Display or they are late for their scheduled rendezvous, Air Display will consider these clients to have cancelled their flight "last minute".  See "Balloon Ride Cancelation Fees" for details.

If at the time of boarding, the client or a member of the client's party refuses to fly (i.e. the balloon ride was a surprise to someone) and an acceptable (to Air Display) replacement passenger is not provided by the client, then Air Display will consider the reservation cancelled "last minute".   See "Balloon Ride Cancellation Fees".

Balloon Ride Cancellation Fees

If the client cancels their reserved flight with less than seven days but more than 48 hours notice to Air Display from the time of their reservation, the "short notice" cancellation penalty is 15% of the total fare.

For clients who do not have a Balloon Ride Certificate or Voucher, the penalty will be charged to the reserving credit card.

 

For clients with a Balloon Ride Certificate, the penalty must be paid to Air Display within 5 business days or the certificate will be considered redeemed.

 

For clients with a Balloon Ride Voucher, the penalty must be paid to Air Display within 5 business days or the voucher will be considered redeemed.

If the client cancels their reserved flight with less than 48 hours notice from the time of their reservation to Air Display or is late for their scheduled rendezvous or fails to show, the "last minute" cancellation penalty is 100% of the fare.

For clients who do not have a Balloon Ride Certificate, the penalty is the balance of the full fare charged to the reserving credit card.

 

For clients with a Balloon Ride Certificate, the certificate will be considered redeemed.

 

For clients with a Balloon Ride Voucher, the voucher will be considered redeemed and the balance of the full fare will be charged to the reserving credit card.

Hot Air Balloon Flight Regime

Rolland Enterprises Inc. conducts fare-paying passenger rides under a Special Flight Operations Certificate (SFOC) issued by Transport Canada.

 

Hot air balloon pilots are Transport Canada licensed.  Pilots must remain current as per the Canadian Aviation Regulations (CARs).  Pilots must be medically fit as certified by Transport Canada aviation medical experts. 

 

The hot air balloons owned by Rolland Enterprises Inc. are Transport Canada, certified aircraft.  Certified aircraft must abide by the inspection and maintenance rules defined by the CARs.

 

Hot air balloon flights are conducted under Visual Flight Rules (VFR) as defined by the CARs.

Balloon Ride Limits of Liability

Balloon flights are subject to the CARs Part IV, "General Operating Flight Rules", Section 606.02: Liability Insurance, Subsection (1), (2), (3) and (5).  This section applies to every owner of every aircraft registered in Canada.

 

Subject to Subsection (3), no operator of a balloon in which fare-paying passengers are carried on board, shall operate an aircraft unless, in respect of every incident related to the operation of the aircraft, the operator has subscribed for liability insurance covering risks of injury or death of a passenger in an amount that is determined by multiplying $300,000 by the number of passengers on board the aircraft.  The insurance coverage referred to in Subsection (3) need not extend to any passenger who is carried on board for the puropose of conducting a parachute decent.

 

No balloon owner shall operate an aircraft unless, in respect of every incident related to the operation of the aircraft, the owner has subscribed for liability insurance covering risks of public liability in an amount not less than $1,000,000 where the maximum permissible take-off weight of the aircraft is not greater than 7,500 lbs.

 

Rolland Enterprises Inc. assumes no liability for lost or damaged bagggage, personal effects (including clothing) or inconvenience of the passenger or any member of the passenger's party.

 

Rolland Enterporises Inc. is not responsible for parking, admission, accommodation or travel costs incurred by the passenger or any member of the passenger's party.

 

By scheduling a balloon ride with Rolland Enterprises Inc. the passenger agrees to the terms of the Rolland Enterprises Inc. "WAIVER".
